Monitoring[1]: Doctors received special short-term training

It should be noted that the monitoring of the implementation of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 is prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan. Its purpose is to guide the implementation of legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.

According to the monitoring report, regarding subparagraph 6 of paragraph 13 of the plan, responsible for the implementation of which is the Ministry of Health and Social Protection of Population and consists of assessing the establishment of an independent medical service for medical care to detainees, prisoners and convicted persons, it is reported that the working group analyzed the Law of the Republic of Tajikistan "On state forensic examination", as well as the experience and regulatory framework of legal assistance of other states, in which an independent forensic medical examination is institutionally operating. Considering the results of the analysis, the Ministry is working on the conclusions and recommendations for drafting amendments and additions to the Law of the Republic of Tajikistan "On the State Forensic Examination" and other procedural legislation of the country in due time.

- Also, the principle of doctor’s independence is considered as one of the recommendations of the Istanbul Protocol and the majority of health care specialists, as well as doctors of detention facilities (doctors of the penitentiary system), have received special short-term training on the standards of examination of detainees following the Istanbul Protocol recommendations.

Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.

How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!

Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.

Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.

The stateimpose a total ban on torture and the obligation to monitor and punish the perpetrators.
