Monitoring[1]: meetings were held on freedom from torture

It should be noted that the monitoring of the implementation progress of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 was prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan. Its objective is to guide the efforts to implement legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.

Concerning the implementation of paragraph 1, subparagraph 2, and paragraph 5, subparagraph 2 of the plan, the monitoring report states that “to prevent torture and other cruel, inhuman and degrading treatment and punishment and to improve the professional skills of judges, prosecutors, law enforcement officials and other specialists on freedom from torture and other cruel treatment, on  March 11-19, 2019, the central office of the body together with the representative office of the Commissioner for Human Rights in GBAO held meetings and round tables with the management and employees of the Departments of Internal Affairs in Darvoz, Vanj, Rushon, Shugnon, Roshtkala, Ishkoshim districts, Khorog city and the Department of Internal Affairs in GBAO on the “Rights of detainees”, “Prevention of torture and other cruel, inhuman and degrading treatment and punishment”, “Preventing terrorism and extremism”.

To improve the professional skills of judges and judge assistants, in 2019, the staff of the Office of the Commissioner for Human Rights held a two-day seminar for 60 judges and judge assistants. Also, in 2019, the team of the Office of the Commissioner for Human Rights conducted round tables in military units 06870, 02615, 07033, 12019 and 08010 of the Ministry of Defense of the Republic of Tajikistan for officers and soldiers, one of the topics was “Torture, inhuman and cruel treatment are not allowed against any person”.

- To improve the professional skills of law enforcement officers and other specialists on the issues related to freedom from torture and other ill-treatment, the staff of the Office of the Commissioner for Human Rights conducted round tables on “Prevention of terrorism” and “Prevention of torture and other ill-treatment”: on August 11, 2020 in the Department of Internal Affairs of Baljuvan District of Khatlon Region, on September 15, 2020 in the Department of Internal Affairs of Shugnan District of GBAO, on September 17, 2020 in the TT YT9/3-i of the Main Department of Internal Affairs of the Republic of Tajikistan in Khorog City of GBAO, on October 20, 2020 in the Department of Internal Affairs of Tajikabad District, on October 30, 2020 in the MI YAS 3/8-i GUIUN of the Republic of Tajikistan in Nurek, on November 05, 2020 in MI YAS 3/5-i GUIUN of the Republic of Tajikistan in Khujand, on November 30, 2020 in the military unit 12019, on December 17, 2020 in the military unit 08010 and on December 18, 2020 in the military unit 02615 of the Ministry of Defense of the Republic of Tajikistan, as stated in the report.

Also, to raise the awareness of the military personnel, the Commissioner for Human Rights together with the NGO “Office for Civil Liberties” handed over books and booklets on “Suicide Prevention in the Army” (300 copies), “Soldier's Handbook" - 600 copies, "Protection of the basic rights and freedoms of conscripts and military personnel" (10 copies), "Handbook for Physicians of the Initial Military Registration Commission" (50 copies), "The Rights of Military Personnel". (50 copies) to the Ministry of Defense, and books on "Preventing Suicide in the Army" (4 copies) and "Soldier's Book" (60 copies) to the Main Department of Penal Execution of the Ministry of Justice.

Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.

How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!

Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.

Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.

The stateimpose a total ban on torture and the obligation to monitor and punish the perpetrators.
